the things in question i know there for gearbox only.
the character skin called gearbox and the vehical skin called nova star. if so how much trouble can someone get into if a gearbox administrator/moderator catches you using them. as in what punishment will be dealt out and for how long.
i'm not denying nor am i adminting that i have them i'm just trying to look out for my fellow BL2 gammers.
i'm not trying to encourage modding as i know it's the only way to get these things nor am i encouraging people to dup them as doing so might make it so the person could get punished as well(if they don't play dumb)

There is no way to know unless you ask someone at Gearbox... We are just documenting the game. I do know that there are a couple ways to get the skins. One is to hack or construct them using an outside program (don't ask me which or how cause I don't use them). The other is an original chain from a Gearbox employee that duped them in the first place (I imagine it has been done).
Again, Gearbox is the only entity to answer your question. As far as your fellow BL2 gamers go, just tell them to back up their saves unless they own the construction program (then they will not worry about it since they can create characters and gear of any level). If your fellow gamers are into mods/constructs there is also pirated games available and there is always risk in pirating/modding, from viruses on the torrent files to account ban.
Letting your fellow gamers know the ultimate risk is the only way to look out for them but that usually is met with being blown off or even laughed at for your concern.
Basically, if it is not you... Don't worry about it.

The Nova Star skin to the vehicle is a random drop from loot-piles. Meaning that it is intended to be a skin you can have. (Just found one in a stalker pile) - Greetings Zerot Zallander (talk) 16:47, March 24, 2014 (UTC)
